Welcome to Bush Coding! These Terms and Conditions ("Terms") govern your use of our services and products, including Aptly, Classify, and Safe Haven. By accessing or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, accessing, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our services.

2. Eligibility

You must be at least 13 years old to use our services. If you are under 18, you must have permission from a parent or legal guardian. By using our services, you represent and warrant that you meet these eligibility requirements.

3. User Accounts

To access certain features of our services, you may be required to create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Providing accurate and complete information during registration
• Updating your account information to keep it current
• Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activities.

You agree to use our services only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Violate any applicable laws, regulations, or third-party rights
• Upload, post, or transmit any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity
• Interfere with or disrupt the operation of our services or servers
• Attempt to gain unauthorized access to our systems, accounts, or networks
• Use automated systems (bots, scrapers, etc.) without our express written permission
• Reverse engineer, decompile, or disassemble any part of our services
• Remove, obscure, or alter any copyright, trademark, or proprietary rights notices

5. Intellectual Property Rights

All content, features, and functionality of our services, including but not limited to text, graphics, logos, images, software, and code, are owned by Bush Coding or our licensors and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use our services for personal or internal business purposes. This license does not include the right to:

• Reproduce, distribute, modify, or create derivative works from our content
• Use our services for commercial purposes without our written consent
• Use our trademarks, logos, or branding without authorization

6. User Content

Our services may allow you to submit, upload, or post content ("User Content"). You retain ownership of your User Content, but you grant Bush Coding a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, modify, adapt, publicly display, and publicly perform your User Content in connection with operating and providing our services.

You represent and warrant that you have all necessary rights to grant this license and that your User Content does not violate any third-party rights or applicable laws.

7. Payment and Subscriptions

Certain features of our services may require payment of fees. By subscribing to a paid service, you agree to:

• Pay all applicable fees as described at the time of purchase
• Provide accurate and complete billing information
• Authorize us to charge your payment method for recurring subscriptions
• Pay all applicable taxes related to your purchase

Subscription fees are billed in advance on a recurring basis (monthly, annually, etc.) and are non-refundable except as required by law or as stated in our Refund Policy.

8. Cancellation and Termination

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period, and you will retain access to paid features until that time.

We reserve the right to suspend or terminate your access to our services at any time, with or without notice, for violations of these Terms, fraudulent activity, or any other reason we deem appropriate.

9. Disclaimers and Limitation of Liability

Our services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee that our services will be uninterrupted, error-free, secure, or free from viruses or other harmful components. You use our services at your own risk.

To the maximum extent permitted by law, Bush Coding and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of our services.

In no event shall our total liability exceed the amount you paid to us in the twelve (12) months preceding the claim, or $100, whichever is greater.

10. Indemnification

You agree to indemnify, defend, and hold harmless Bush Coding and its affiliates, officers, directors, employees, and agents from any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of our services
• Your violation of these Terms
• Your violation of any rights of another party
• Your User Content

11. Third-Party Services and Links

Our services may contain links to third-party websites, applications, or services that are not owned or controlled by Bush Coding. We are not responsible for the content, privacy policies, or practices of any third-party services. Your use of third-party services is at your own risk, and you should review their terms and policies.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of our services after such changes constitutes acceptance of the modified Terms.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Costa Rica, without regard to its conflict of law provisions.

Any disputes arising out of or related to these Terms or our services shall be resolved through good faith negotiations. If negotiations fail, disputes shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration authority in Costa Rica.

14. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us, constitute the entire agreement between you and Bush Coding regarding your use of our services.
