Terms of Service

These Terms of Service ("Terms") are an agreement between you and Bush Coding for the use of our apps and websites: Classify, Aptly, Stash, Germina, bushcoding.com and any other product that links to these Terms (together, the "Services"). Section 9 adds the rules that only apply to a specific product. By creating an account, buying a plan or using a Service, you accept these Terms and our Privacy Policy.

1. Who can use the Services

You must be at least 13 years old, or the minimum age required in your country, to use a Service, and old enough to enter into a contract to buy a paid plan. If you use a Service for a company or other organization, you confirm that you can accept these Terms on its behalf, and "you" includes that organization.

2. Accounts

Some Services require an account. Give us accurate information, keep your password and any tokens secret, turn on two-step verification where it is available, and tell us right away at contact@bushcoding.com if you suspect unauthorized access. You are responsible for what happens under your account and for the people you invite to your team or business.

3. Free plans, paid plans and billing

  • Each Service describes on its pricing page what its free plan includes and what its paid plan adds. We may change the limits of free plans at any time.
  • Paid plans are subscriptions that renew automatically each month or year until you cancel. On the web they are billed by Stripe; in mobile apps, by Google Play or the App Store under their terms.
  • Prices are shown before you pay and are charged in the currency shown, plus any taxes that apply. If we change the price of your plan, we will tell you at least 30 days in advance and the new price will apply from your next renewal.
  • If a payment fails, we or the store may retry it. If it still fails, your account returns to the free plan when the paid period ends.
  • Refunds are covered by our Refund Policy.

4. Cancellation

You can cancel a subscription at any time: from the account or billing settings of the web app (which open Stripe's customer portal), or from Google Play or the App Store for purchases made there. Cancellation stops future renewals; you keep the paid features until the end of the period you already paid for, and then your account returns to the free plan. Your data is not deleted when you cancel; to delete it, delete your account.

5. Acceptable use

You agree not to:

  • break the law, infringe other people's rights or use the Services to store or send unlawful content;
  • access accounts, data or systems without permission, or probe, scan or test the security of the Services without our written authorization;
  • overload, disrupt or reverse engineer the Services, or get around their limits or plan restrictions;
  • use bots or scraping to access the Services except through features or APIs we provide for that;
  • send spam or contact people through the Services without a lawful basis;
  • resell or sublicense the Services without our written permission.

6. Your content

You keep all rights to the data, files and other content you put in the Services ("Your Content"). You give us only the permission we need to host, process, transmit and display Your Content to provide the Services to you and to the people you share it with. We do not use Your Content to train AI models or for advertising. You are responsible for having the right to use Your Content and for keeping your own backups where a product works only on your device.

7. Our software and brands

The Services, including their software, design and the names Bush Coding, Classify, Aptly, Stash and Germina, belong to Bush Coding or its licensors. We give you a personal, non-exclusive, non-transferable license to use the Services under these Terms. Mobile apps are also licensed under the terms of the store you got them from (for the App Store, Apple's standard licensed application end user license agreement). If you send us feedback, we may use it without obligation to you.

8. Changes, availability and betas

We keep improving the Services and may add, change or remove features. We will give reasonable notice before removing a feature that is central to a paid plan. We aim for the Services to be available at all times but do not guarantee it; maintenance and outages can happen. Features or products marked "beta" (such as Aptly today) may change and may have more errors than usual.

9. Product-specific terms

Classify

  • Classify is an organizing tool, not tax or accounting advice. It reads the data in the invoices you provide and applies the rules described in its help pages. You are responsible for reviewing the results, the totals and the tax figures before using them in any return or report.
  • Your files are processed only in your browser. We cannot see or recover them, so keep your own copies.
  • The free plan has the limit shown on the pricing page. Getting around plan limits, for example by modifying the app, is a breach of these Terms.

Aptly

  • Aptly is a tool for businesses to take appointments. It is not a party to the relationship between a business and its customers. Each business is solely responsible for its services, prices, schedules, cancellations and no-shows, and for complying with the laws that apply to it, including privacy laws for the customer data it receives.
  • Customers do not pay through Aptly. Any payment for a service is made directly between the customer and the business.
  • Appointment reminders are sent as a convenience; we do not guarantee that every reminder will be delivered or read.
  • Aptly Premium is billed per business (hub).

Stash

  • You decide which secrets you store, who can access them and which tokens and integrations can read them. You are responsible for managing team members and roles, revoking tokens and access you no longer need, and protecting the devices and files where you pull secrets (such as local .env files and CLI configuration).
  • We are not responsible for exposure of secrets caused by credentials, tokens, devices or integrations under your control, or by the services you choose to sync secrets to.
  • Do not store data you are not allowed to store (for example, payment card numbers subject to PCI DSS) unless you have confirmed that your use complies with the rules that apply to you.

Germina and other on-device apps

  • Your data is stored only on your device. Deleting the app or losing your device deletes it unless you made a backup.
  • Purchases are sold and refunded by Google Play or the App Store under their terms.

Custom software and services

Websites, apps and other work we build for clients are governed by the proposal or contract signed for that project. These Terms apply to that work only for matters the contract does not cover.

10. Disclaimers

Except for the commitments we make in these Terms and where the law does not allow it, the Services are provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. Nothing in these Terms limits rights you have as a consumer that cannot be waived under the law of the place where you live.

11. Limitation of liability

To the extent the law allows, Bush Coding is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim related to the Services is limited to the greater of the amount you paid us for the Service involved in the 12 months before the claim and US$100. These limits do not apply to liability that cannot be limited by law, such as for intentional misconduct or gross negligence.

12. Indemnity

If you use a Service for business purposes, you will defend and compensate Bush Coding for claims by third parties arising from Your Content, your use of the Service in breach of these Terms, or, for Aptly businesses, your relationship with your customers.

13. Suspension and termination

You can stop using a Service and delete your account at any time. We may suspend or close an account that seriously or repeatedly breaks these Terms, puts other users or the Services at risk, or that we must close by law. When possible we will warn you first and give you a chance to export your data. If we close your account without a breach on your part, we will refund the unused part of any prepaid plan.

14. Governing law and disputes

These Terms are governed by the laws of Costa Rica. Before starting any claim, please contact us so we can try to solve the problem; most issues are solved this way. If we cannot agree, disputes will be resolved by the competent courts of Costa Rica. If you are a consumer, you also keep the protection of the mandatory laws of the place where you live and can bring a claim there.

15. General

  • We may update these Terms. We will change the date at the top and, for significant changes, notify account holders at least 30 days before they take effect. If you keep using the Services after that, the new Terms apply; if you do not agree, you can cancel and delete your account.
  • If a provision is found invalid, the rest of the Terms remain in effect.
  • Not enforcing a provision is not a waiver of it.
  • You may not transfer these Terms without our consent; we may transfer them with our business.
  • These Terms, the Privacy Policy, the Refund Policy and any project contract are the entire agreement between you and Bush Coding about the Services. If a translation differs from the English version, the English version prevails, unless the law where you live requires otherwise.
